Service Ownership<\/strong><\/h2>\n<p>The website <a href=\"http:\/\/www.scoringmy.com\/\"><strong>www.scoringmy.com<\/strong><\/a> and the ScoringMy digital tool (hereinafter, \u201cthe Platform\u201d) are owned by <strong>PEOPLEXBRAND ACELERADORA S.L.<\/strong>, Tax ID <strong>B-56994916<\/strong>, registered address at <strong>C\/ Gregorio Ben\u00edtez 10, 28043 Madrid<\/strong>, and contact email <strong>legal@scoringmy.com<\/strong>.<\/p>\n<h2><strong>2. Purpose<\/strong><\/h2>\n<p>These terms govern access to, use of, and contracting of the services offered through the ScoringMy Platform, a tool that enables users and organizations to visualize and understand their digital professional presence, as well as obtain personalized improvement recommendations.<\/p>\n<p>The use of ScoringMy implies full and express acceptance of these Terms of Use and Contracting, as well as the Privacy Policy and the Cookies Policy.<\/p>\n<h2><strong>3. General Description of the Service<\/strong><\/h2>\n<p>ScoringMy enables its users to:<\/p>\n<ul>\n<li>Analyze and visualize their digital professional presence based on public information from LinkedIn.<\/li>\n<li>Receive a \u201cscore\u201d together with improvement recommendations.<\/li>\n<li>Create a business account and view aggregated employee results.<\/li>\n<li>Perform comparisons with public profiles of third parties or competitors for internal informational purposes.<\/li>\n<\/ul>\n<h2><strong>4. Types of Users<\/strong><\/h2>\n<p>ScoringMy may be used by:<\/p>\n<ol>\n<li><strong>Individual users<\/strong> who register on their own behalf and use the tool to improve their personal branding.<\/li>\n<li><strong>Business users<\/strong> who register as individuals and subsequently declare that they act on behalf of their organization within their account.<\/li>\n<li><strong>Invited employees<\/strong> who are added to the system by their companies and who expressly accept their participation.<\/li>\n<\/ol>\n<h2><strong>5. Registration and Account Creation<\/strong><\/h2>\n<p>To access the Platform, users must register by providing their <strong>full name and email address<\/strong>, either manually or through <strong>Google Connect<\/strong> authentication.<\/p>\n<p>This data is used solely to create the account and manage access to the service.<br \/>\nThe user declares that the information provided is truthful and undertakes to keep it up to date.<\/p>\n<p>Registration is the same for all users, and afterward, within their account, they may:<\/p>\n<ul>\n<li>Create their company profile.<\/li>\n<li>Upload employee email addresses to invite them.<\/li>\n<li>Use ScoringMy for personal purposes.<\/li>\n<\/ul>\n<h2><strong>6. Business Use and Company Creation<\/strong><\/h2>\n<p>When a user decides to create a company within their account, they declare that they act on its behalf with sufficient authorization.<br \/>\nOnce created, they may invite employees or view aggregated organizational data.<\/p>\n<ul>\n<li>At this stage, the <strong>Client (company)<\/strong> acts as the <strong>Data Controller<\/strong>.<\/li>\n<li><strong>PeopleXBrand<\/strong> acts as the <strong>Data Processor<\/strong>, limiting the use of the data to sending the corresponding invitations.<\/li>\n<\/ul>\n<h2><strong>7. Processing of Employee Data<\/strong><\/h2>\n<p>When the user uploads employee email addresses for invitation purposes:<\/p>\n<ul>\n<li>The emails will be used <strong>solely to send informational communications and request the employee\u2019s consent<\/strong> to participate in the program.<\/li>\n<li>If the employee <strong>does not provide consent<\/strong>, the data will be automatically deleted.<\/li>\n<li>No <strong>individualized analysis<\/strong> is performed until the employee accepts.<\/li>\n<\/ul>\n<p>Once the employee gives consent and creates their account, <strong>PeopleXBrand becomes the Data Controller<\/strong> for those personal data.<\/p>\n<h2><strong>8. Analysis of Public Data from Third Parties and Competitors<\/strong><\/h2>\n<p>ScoringMy may incorporate data obtained manually from public LinkedIn profiles and other open sources.<br \/>\nThis processing is based on the Client\u2019s <strong>legitimate interest<\/strong> for internal analysis and market evaluation.<\/p>\n<p>PeopleXBrand guarantees that:<\/p>\n<ul>\n<li>No mass or automated scraping is carried out.<\/li>\n<li>No commercial databases are created.<\/li>\n<li>Reports generated are for internal and private use.<\/li>\n<\/ul>\n<p>The CLIENT may not use competitor data for outreach, advertising, or commercial activities.<\/p>\n<h2><strong>9. Service Plans<\/strong><\/h2>\n<p>ScoringMy offers three access levels:<\/p>\n<ol>\n<li><strong>Free Account:<\/strong> basic visualization of one\u2019s own score.<\/li>\n<li><strong>Data Account:<\/strong> access to aggregated employee data.<\/li>\n<li><strong>Data &amp; Tips Account:<\/strong> also includes recommendations and advanced metrics.<\/li>\n<\/ol>\n<h2><strong>10. Pricing Conditions<\/strong><\/h2>\n<p>Services may be contracted:<\/p>\n<ul>\n<li>Through a monthly subscription (via Stripe), or<\/li>\n<li>Through direct contracting with invoicing issued by PeopleXBrand.<\/li>\n<\/ul>\n<p>Payment shall be made by <strong>bank transfer upon invoice<\/strong> or another method agreed between the parties.<\/p>\n<h2><strong>11. Intellectual Property<\/strong><\/h2>\n<p>All elements, software, graphics, and methodology of ScoringMy are the exclusive property of PeopleXBrand Aceleradora S.L.<br \/>\nUsers are granted only a limited right of use.<\/p>\n<h2><strong>12. Prohibited Use, Security, and Measures Against Unlawful Use<\/strong><\/h2>\n<p><strong>12.1. Prohibited Uses.<\/strong><br \/>\nThe User agrees not to use the Platform, the service, or any of its functionalities, whether directly or indirectly, for any of the following expressly prohibited purposes:<\/p>\n<p>a) performing reverse engineering, decompiling, disassembling, deobfuscating, translating, extracting, modifying, converting into high-level language, or creating derivative works from the software, code, algorithms, models, APIs, or technical content of the Platform;<br \/>\nb) attempting to access, copy, export, reproduce, distribute, or exploit the source code, internal processes, databases, data models, or technical documentation of the Platform without express written authorization from PeopleXBrand;<br \/>\nc) introducing, uploading, distributing, or executing viruses, trojans, bots, worms, ransomware, logic bombs, backdoors, scripts, or other programs or routines capable of damaging, intercepting, spying, accessing, or interrupting the Platform or third-party systems;<br \/>\nd) bypassing, disabling, or breaching security measures, access control systems, intellectual property protections, or fraud prevention mechanisms implemented in the Platform;<br \/>\ne) performing penetration tests, automated scans, mass scraping, fuzzing, or other intrusion techniques on the Platform or its infrastructure without prior specific written authorization from PeopleXBrand;<br \/>\nf) using information obtained through the Platform for unlawful, fraudulent, unauthorized commercial, harassing, or rights-violating activities;<br \/>\ng) sharing access credentials, selling, renting, or transferring access to the Platform to third parties without contractual authorization.<\/p>\n<p><strong>12.2. Prohibition of Reverse Engineering and Technical Analysis.<\/strong><br \/>\nThe User acknowledges that they are strictly prohibited, under all circumstances, from attempting any form of reverse engineering\u2014direct or indirect\u2014using manual or automated tools or methods aimed at discovering, extracting, reconstructing, or reproducing the code, architecture, algorithms, APIs, technical documentation, or any trade secret of PeopleXBrand.<\/p>\n<p><strong>12.3. Security, Integrity, and Incident Notification.<\/strong><br \/>\na) Users must adopt ordinary and diligent security measures to protect their credentials and access to the Platform.<br \/>\nb) If any vulnerability, misuse, or security incident is detected (including intrusion attempts, credential compromise, or indications of malicious code execution), the User must immediately notify PeopleXBrand at <strong>legal@scoringmy.com<\/strong>, providing all available information (date, time, description, relevant logs) and cooperate in good faith with investigations and containment measures. Failure to notify increases the User\u2019s liability for resulting damages.<\/p>\n<p><strong>12.4. Mitigation and Suspension Rights.<\/strong><br \/>\nPeopleXBrand may, without prior notice and without liability for indirect damages:<br \/>\na) block or temporarily\/permanently suspend accounts or connections that\u2014based on reasonable judgment\u2014are engaging in prohibited activities or pose a security risk;<br \/>\nb) limit, degrade, or interrupt services or features when reasonable indications of misuse, attacks, or exploitation exist;<br \/>\nc) take legal and technical actions necessary to protect its rights, including data recovery, breach remediation, and cooperation with authorities.<\/p>\n<p><strong>12.5. Cooperation, Compensation, and Costs.<\/strong><br \/>\nThe User shall be liable for, and must indemnify and hold PeopleXBrand harmless from, any claims, damages, losses, costs, and expenses (including reasonable attorneys\u2019 fees and court costs) arising from: (i) misuse of the Platform; (ii) execution of malicious software introduced or enabled by the User; (iii) reverse engineering or security breaches; or (iv) any violation of these Terms.<br \/>\nThe User shall also assume reasonable technical costs required to remedy incidents caused by their conduct.<\/p>\n<p><strong>12.6. Precautionary Remedies and Criminal Measures.<\/strong><br \/>\nThe User acknowledges that breach of this section causes irreparable harm to PeopleXBrand. PeopleXBrand may seek precautionary measures (including access suspension, provider notices, and judicial or administrative actions) and report conduct to authorities when criminal activity is suspected.<\/p>\n<p><strong>12.7. Responsible Disclosure of Vulnerabilities (Informal Bug Bounty).<\/strong><br \/>\nPeopleXBrand values responsible disclosure. If a third party identifies a vulnerability, they must refrain from exploiting it and report it immediately to <strong>legal@scoringmy.com<\/strong>, providing enough detail to reproduce and correct the issue.<br \/>\nAny exploitation, public disclosure, or attempt to obtain financial benefit without prior agreement will be deemed misuse and subject to the actions described in these Terms.<\/p>\n<p><strong>12.8. Limitation of Liability for Acts of Third Parties.<\/strong><br \/>\nPeopleXBrand shall not be liable for indirect damages, loss of profits, or data loss caused by external attacks, known or unknown vulnerabilities, or malicious third parties, unless caused by willful misconduct or gross negligence by PeopleXBrand.<br \/>\nIn any case, PeopleXBrand\u2019s total liability shall not exceed the amounts effectively paid by the Client in the last twelve (12) months for contracted services, except in cases of willful misconduct or gross negligence.<\/p>\n<p><strong>12.9. Preservation of Evidence.<\/strong><br \/>\nThe User agrees that PeopleXBrand may collect, retain, and use logs, forensic footprints, and other technical information necessary to investigate potential security violations and for use in legal or administrative proceedings. The User expressly consents to providing such information to competent authorities when legally required.<\/p>\n<h2><strong>13. Non-Affiliation with LinkedIn and Third-Party Intellectual Property<\/strong><\/h2>\n<p>13.1. ScoringMy is an independent data-analysis and insights tool. The service <strong>is not affiliated, associated, authorized, endorsed, or sponsored by LinkedIn Corporation<\/strong> or any of its subsidiaries or affiliates.<\/p>\n<p>13.2. The <strong>LinkedIn<\/strong> trademark, logo, and trade name are the exclusive property of <strong>LinkedIn Corporation<\/strong>.<\/p>\n<p>13.3. The use of the LinkedIn trademark within the Platform and communication materials is solely for descriptive purposes to identify the source of the analyzed data, in accordance with the principle of referential use.<\/p>\n<p>13.4. The Client and the user acknowledge that access to and use of public LinkedIn information through ScoringMy must comply with LinkedIn\u2019s terms of use.<\/p>\n<h2><strong>14. Limitation of Liability<\/strong><\/h2>\n<p>PeopleXBrand does not guarantee the accuracy or timeliness of the public information analyzed.<br \/>\nIt is not responsible for any misuse of reports by the Client or user.<\/p>\n<h2><strong>15. Personal Data Protection<\/strong><\/h2>\n<p>The processing of personal data is governed by the Privacy Policy and, where applicable, the <strong>Data Processing Agreement (AET\/DPA)<\/strong>.<\/p>\n<h2><strong>16.
